    Our Services

    When a property is earmarked for resumption, there are two processes that a resuming authority can acquire your land:
    1. An Early Acquisition Application lodged by the property owner with the resuming authority for it to acquire the property on hardship grounds; or
    2. A Notice of Intention to Resume (NIR), issued by the resuming authority as the first step in the formal resumption process.

    Early Acquisition Application

    We can assist you with preparing and lodging your early acquisition application (application) by:
    (a) identifying the best grounds that will increase your chances of securing an approval;
    (b) obtaining any necessary third party information required for the application; and
    (c) ensuring that only relevant information is included depending on the ground/s used to make the application;
    The cost of our preparing the application is not reimbursed by the resuming authority, however once the application is approved…

    Formal Resumption

    If you are not interested in lodging an early acquisition application and would prefer to wait for formal resumption, that process is commenced with a Notice of Intention to Resume (NIR). After the NIR is issued, the taking is formalised by Notice published in the Government Gazette. From Gazettal you have 3 years within which to make a claim for compensation. If that 3 year period has expired, you can only proceed with the consent of the resuming authority, or the consent of the Court. You must have compelling reasons for not acting within that 3 year time frame.
